Nor is it compensation for any act that violates your conditions of residence in Canada.<\/p>\n<h3>The reasons<\/h3>\n<p>There are several valid reasons for losing permanent resident status:<\/p>\n<ul>\n<li>Non-compliance with the residency obligation, i.e., not being in Canada for 730 days in each five-year period;<\/li>\n<li>False or misleading representations made orally or in writing in any application for permanent residence;<\/li>\n<li>Inadmissibility, having been convicted of crimes committed in Canada or abroad;<\/li>\n<li>Issuance of a removal order, forcing departure from Canada<\/li>\n<\/ul>\n<h3>The crime<\/h3>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-3881\" src=\"https:\/\/www.langlais.com\/wp-content\/uploads\/2019\/09\/menotes-300x200.jpg\" alt=\"the crime\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.langlais.com\/wp-content\/uploads\/2019\/09\/menotes-300x200.jpg 300w, https:\/\/www.langlais.com\/wp-content\/uploads\/2019\/09\/menotes-768x512.jpg 768w, https:\/\/www.langlais.com\/wp-content\/uploads\/2019\/09\/menotes-600x400.jpg 600w, https:\/\/www.langlais.com\/wp-content\/uploads\/2019\/09\/menotes.jpg 812w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Permanent residents who have committed a crime in Canada or abroad are likely to lose status or even be issued a removal order forcing them to leave Canada. In some cases, they may be deported from Canada without any right to appeal the order. For example, a person may be inadmissible to Canada on grounds of serious criminality if one of the following conditions apply. If the person:<\/p>\n<ul>\n<li>Has been convicted in Canada of an offense for which a term of imprisonment of at least 10 years is prescribed.<\/li>\n<li>Convicted in Canada of a crime for which a term of imprisonment of more than 6 months is prescribed.<\/li>\n<li>Convicted of committing crimes outside Canada that have an equivalent in Canadian law.<\/li>\n<\/ul>\n<p>The following situations result in inadmissibility and removal orders from Canada. Did you drive while impaired by alcohol or even drugs? Have you used a false identity document to enter a bar while traveling in the United States? Did you assault someone with a knife?<\/p>\n<h3>Other reasons<\/h3>\n<p>There are many <a href=\"https:\/\/www.langlais.com\/en\/our-services\/inadmissibility\/\">other reasons<\/a> that could hinder your <a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/services\/new-immigrants\/pr-card\/understand-pr-status.html\">permanent resident<\/a> status in Canada or even lead to inadmissibility. Do you think these examples seem trivial, and that it is all about punishment, about major crimes? Make no mistake, reasons such as sexual assault, selling cocaine\/heroin\/ magic mushrooms, or even credit card fraud can be held against you.<\/p>\n<h3>Right of appeal if I lose my status?<\/h3>\n<p>Does the permanent resident have a right to appeal a removal order? Certainly, but in such a case, an immigration lawyer who understands criminal issues is paramount. Only he or she will be better able than anyone else to analyze the impact of the charges on your status and represent you adequately in the legal proceedings to appeal the order on humanitarian and compassionate grounds that may apply to your situation.<\/p>\n<p>It is worth recalling that the right to appeal a removal order is lost if the person has been sentenced in Canada to a term of imprisonment of more than six months.
